GOLDEN VISA LEGAL ADVICE
LAST CALL GOLDEN VISA SPAIN – APRIL 3, 2025
END OF THE ‘GOLDEN’ RESIDENCES FOR INVESTORS OF LAW 14/2013 OF ENTREPRENEURS IN SPAIN
Current situation of the Golden Visa/Investor Visa in Spain.
On 3 January, Organic Act 1/2025, of 2 January, on measures for the efficiency of the Public Justice Service, was finally published.
Its 21st Final Provision introduces the amendment of Act 14/2013, of 27 September, on support for entrepreneurs and their internationalisation, by which investor visas are eliminated (Golden Visa Act/Investor Visa in Spain).
The ‘good news’ is that this measure will come into force after 3 months, therefore, on 3 April 2025, it will no longer be possible to apply for a GOLDEN VISA / INVESTOR VISA, as the Law on measures for the efficiency of the public service of Justice provides for the suppression of articles 63 to 67 of Law 14/2013, which until now has regulated the residence regime for foreigners who could apply for residence in Spain for making significant investments in the country.
LAST CALL
What will happen with the applications made until 3 April 2025?
According to the new amendment to the law.
Those interested in applying for the golden investor visa have until 3 April 2025, and those applying before that date will still be able to make use of the law.
Those investors or family members of investors who, prior to the date of entry into force of this transitional provision, have submitted the corresponding application, may receive the corresponding visa or authorisation in accordance with the regulations in force on the date of submission of the application.
The only difficulty that could be applied, as the law does not say anything about it, is that once this date arrives, if the application submitted does not have all the necessary documentation, we do not know how the specific department for this residence application, UGE, will react, this already depends on superior orders that are not contemplated by the law.
Therefore, my advice: hurry up to submit the applications before that date and provide the documents duly apostilled and translated (when they are foreign documents and in another language), that are not older than 3 months (except those that can be submitted with 6 months of age) and, if you have a good lawyer to assist you in the process, the better.
WHAT ABOUT PREVIOUS GOLDEN VISAS?
Exceptionally, the law that has been repealed will apply, both to maintain the residency/visa status and for renewals.
In relation to the renewals of visas and authorizations for financial investors and for the acquisition of real estate (golden visas): “The visas and authorizations for investors that are valid on the date of entry into force of this transitory provision, shall remain valid for the time for which they were issued. In the event that renewal applications are submitted, they will be processed and resolved in accordance with the regulations in force on the date the initial authorization was granted”.
